   1. CarCific provides a platform for dealerships to advertise their cars. We do not own or sell any cars listed on the Services. While we strive to ensure the accuracy of the information provided by dealerships, we do not guarantee the accuracy or completeness of any information on the Services.
   2. You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:
      1. In any way that violates any applicable South African or international law or regulation.
      2. To engage in any fraudulent or misleading activity.
      3. To harass, abuse, or harm another person or entity.
      4. To collect or store personal information about other users of the Services without their consent.
      5. To post, upload, or otherwise transmit any content that is obscene, offensive, defamatory, or otherwise objectionable.
      6. To interfere with or disrupt the Services or servers or networks connected to the Services.
      7. To use any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission.

3. Vehicle Condition Indicator

   1. Please note that the vehicle condition indicator provided on our website is determined by individual dealers at their own discretion. CarCific cannot be held liable for any discrepancies or variations in the vehicle condition indicator. It is important to understand that the assessment of vehicle condition is subjective and may vary between different dealers. Users are advised to exercise their own judgment and discretion when interpreting the vehicle condition indicator and making purchasing decisions based on it.

4. Vehicle Extras or Additional Features

   1. The listing of vehicle extras or additional features on a vehicle is at the sole discretion of the dealers. CarCific holds no liability for any variations or discrepancies in the representation of these extras. It is important to recognize that the inclusion of extras may vary between different dealers and may be subject to change. Users are advised to independently verify the presence of any listed extras during the vehicle inspection process and make informed decisions based on their own assessment. CarCific shall not be responsible for any misunderstandings or disagreements related to the representation of vehicle extras on the website.

5. Information for Insurance Quotes

   1. By using CarCific's services to request insurance quotes or provide information related to insurance, you acknowledge and agree that the information you provide for insurance quotes will be shared with the selected insurance provider(s) for the purpose of obtaining insurance quotes or related services. CarCific's role is limited to facilitating the transfer of this information to the selected insurance provider(s).
   2. CarCific is not liable for any actions, decisions, or outcomes related to the insurance quotes or services provided by the selected insurance provider(s). Any disputes, claims, or issues arising from your interactions with the insurance provider(s) are solely between you and the insurance provider(s).
   3. It is your responsibility to review and understand the terms and policies of the insurance provider(s) before proceeding with any insurance-related services. CarCific does not endorse or warrant the products, services, or information provided by the insurance provider(s) and makes no representations or guarantees regarding their offerings.
   4. By using this service, you agree to release CarCific from any liability, claims, or damages arising from your interactions with the selected insurance provider(s) or any information provided to them.

6. User Accounts

   1. In order to use certain features of the Services, you may need to create a user account. You are responsible for maintaining the confidentiality of your account information, including your username and password, and for all activities that occur under your account. You agree to immediately notify CarCific of any unauthorized use of your account or any other breach of security.

7. Intellectual Property

   1. The Services and all content and materials included on the Services, including but not limited to text, graphics, logos, images, and software, are the property of CarCific or its licensors and are protected by South African and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
   2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services without our express written consent, except as follows:
      1. You may print or download one copy of a reasonable number of pages of the Services for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
      2. If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

8. Disclaimers and Limitation of Liability

CARCIFIC MAKES NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
   2. IN NO EVENT SHALL CARCIFIC OR ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF CARCIFIC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to defend, indemnify, and hold harmless CarCific and its affiliates, licensors, service providers, employees, agents, officers, and directors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

    1. CarCific may terminate your access to the Services or your account at any time, with or without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. All provisions of these Terms that by their nature should survive termination shall survive termination, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or the Services (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of South Africa, without giving effect to any choice or conflict of law provision or rule.
    2. Any legal suit, action, or proceeding arising out of or in connection with these Terms or the Services shall be instituted exclusively in the courts of South Africa, and you irrevocably submit to the exclusive jurisdiction of such courts.

If we make material changes to these Terms, we will notify you by email or by posting a notice on the Services prior to the effective date of the changes. Your continued use of the Services after the effective date of any changes to these Terms constitutes your acceptance of the changes.
